Property Developer Drags On 'Air Personality', Radio Station To Court Alleging Libelous Broadcast

OLORUNDARE ENIMOLA, Lagos

Mr. Elijah Adeogun, the Chairman/CEO of Eli-Ade Properties Nigeria Limited has written the Court to summon Yemi Kazeem the Presenter of a programme called 'Eto Abo' aired every Friday, a Federal Radio Station located in Ikoyi and other defendants to Court for broadcasting a Libelous content against him during a programme presented on Friday August 1, between 9.30-10.00 pm on the station.

In a Suit filled at the Ogun State High Court on behalf of Mr. Elijah Adeogun by Barrister Taiwo Ogunleye, his legal counsel, the lawyer asked the Court to summon and order Mr. Kazeem to appear before it within 30 days and failure to appear, the Court should give judgement on the matter in his absence.

He also asked the Court to order the Defendants to publish a retraction of the entire libelous publication and be made to pay the sum of N50,000,000 (Fifty Million Naira) as damages resulting from the false and malicious broadcast made on 'Eto Abo', with adding the Defendants be made to publish  an apology by way of advertorial in a conspicous page in THE Punch and Nigerian Tribune newspapers.

He also said the Court order the defendants to publish a retraction of the entire libelous publication and an apology by way of broadcast from the first and second Defendants' on the same radio broadcast - Eto Aabo" in at least two consecutive editions thereof.

Furthermore, the Suit is asking for an Order of perpetual injunction restraining the Defendants by themselves, their agents. servants and privies, whatsoever called, from further writing. publishing and /or disseminating any scandalous publication or material calculated at or that tends to defame the Claimant in any manner whatsoever, while adding that the sum of NI0,000, 000 (Ten Million Naira) as damages should be charged against the Defendant for the trespass to the Claimant's property without any lawful justification.

Mr. Elijah through his counsel accused the defendants that on the day of the broadcast, he made false and malicious statements concerning him, claiming he was a notorious landgrabber and disturbing the peace of llasa community, Ota, Ogun State and lying that he is desperately selling landed properties with burial tombs.

The broadcast according to the summon further reads:I "f I hear any longer of your issues in Ilasa, that means that your life is ended. Don't terrorise them in the community, let those carrying on construction in the community be at peace, let them sleep in peace. If land is exhausted, move ahead. The land which you have already sold and on which corpses have been buried, you want to resell them against their wish."

Daily Independent Newspapers, therefore contacted, Mr. Yemi Kazeem, the Programme presenter, to ask for reasons why he did not give Mr. Akogun a fair hearing by bringing him to the broadcast to defend himself, while the other party was airing the allegations, he brushed the matter aside, claiming he is working directly with AIG Fayoade Adegoke the Assistant Inspector-General of Police (AIG) in charge of Zone 2 Command on security matters.

As at going to press, Mr. Kazeem could not give a convincing reason why he did not balance his broadcast by bringing the Akogun party to defend his position on his programme, while allowing the other party to unabatedly malign his name.
